Terms of Use

Effective November 3, 2026

These Terms of Use govern your use of the Lexington Home Loans website. By using the site, you accept these Terms and our Privacy Policy.

1Agreement to These Terms

These Terms govern your use of this website, operated by Lexington Mortgage Corporation, dba Lexington Home Loans (NMLS #347811). Using the site means you accept these Terms and the Privacy Policy. If you disagree, please stop using the site.

These Terms cover only your use of the site. Loan inquiries, applications, extensions, closings, and servicing are governed by your loan documents, the required disclosures, and applicable law, which control in the event of a conflict. Your rights under federal or state law regarding a loan are unaffected.

2Information Only; No Offer or Commitment to Lend

Site content — including program descriptions, rates, terms, calculators, and examples — is general information only. It is not an offer, commitment, rate lock, or guarantee of approval, rate, fees, or terms.

All loans depend on application, credit approval, underwriting, property eligibility, and program guidelines. Programs and rates may change without notice and may not be available everywhere. Calculator results are illustrations. Nothing on the site is legal, tax, or financial advice.

3Permitted Use and Prohibited Conduct

You may view and print site materials for personal, noncommercial use. Without our written permission, you may not copy, modify, distribute, sell, or create derivative works from site content.

You also may not use bots or scrapers (including to build lists), access nonpublic areas, disrupt the site or introduce malicious code, impersonate anyone, submit false or others’ information, or use the site unlawfully. Violating these Terms automatically ends your permission to use the site.

4Information You Provide

Information you submit must be true, accurate, complete, and provided with authority. Personal information is handled under the Privacy Policy and the federal privacy notice for customers.

Please do not send Social Security or account numbers through general forms or email; your loan team will provide a secure method when needed. Feedback you send is not confidential, and we may use it for any purpose without payment to you. Your personal information remains protected under the Privacy Policy.

5Text Messages

If you opt in, texts concern your own inquiry, application, or loan — such as status updates, document requests, and appointment reminders. Frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help.

Agreeing to texts is never required to apply for or obtain a loan. Carriers are not liable for delayed or undelivered messages. Mobile information is not shared with third parties or affiliates for marketing. The Text Messaging Terms govern the texting program and control for text messages.

6Ownership and Trademarks

Site content — including text, graphics, logos, images, software, and the selection and arrangement of materials — is owned by or licensed to Lexington and protected by law. © 2007–2026 Lexington Mortgage Corporation. All rights reserved.

Lexington’s marks, including LEXINGTON®, Lexington Home Loans, Signature of Excellence, and the Lexington logo, may not be used without written permission. Other marks belong to their owners.

7Third-Party Websites

The site may link to sites operated by others, such as government agencies, credit bureaus, and service providers. These links are for convenience only and do not imply endorsement. We do not control or take responsibility for those sites, their content, products, or privacy practices. Their own terms and privacy policies apply to your use of them.

8Disclaimer of Warranties

To the fullest extent the law allows, the site and its content are provided “AS IS” and “AS AVAILABLE,” with all express and implied warranties disclaimed. We do not promise uninterrupted, error-free, or virus-free operation, or that content is accurate, complete, or current.

Technical or typographical errors may occur, and content may be changed at any time without notice. This section does not waive rights that cannot be disclaimed by law, and it does not apply to any loan.

9Limitation of Liability

(a) Excluded damages. To the fullest extent the law allows, Lexington and its affiliates, officers, employees, agents, and licensors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, use, or goodwill, arising from the site or these Terms, under any legal theory, even if warned.

(b) Cap. Total aggregate liability for all claims is limited to the greater of (i) what you paid us to use the site, if anything, or (ii) US$100.

(c) Exclusions. Nothing here limits liability for fraud, willful injury, or violations of law under California Civil Code section 1668; death or personal injury where limits are not allowed; loan-related matters; or anything else that cannot legally be limited.

(d) Basis of the bargain. The site is free, and these provisions reflect a reasonable allocation of risk. They apply even if a limited remedy fails its purpose.

10Indemnification

To the extent permitted by law, you agree to defend and hold harmless Lexington, its affiliates, and their personnel from third-party claims, losses, costs, and reasonable attorneys’ fees caused by your violation of these Terms or misuse of the site. This does not apply where the claim is caused by our own negligence or misconduct, or to any loan.

11Informal Resolution First

Concerns about the site should first be sent to legal.dept@lexingtonhl.net or the mailing address listed below. Before either party starts arbitration or a lawsuit over a Website Dispute, the disputing party must send a written description, and both parties then try in good faith to resolve it informally for 30 days. This step does not apply to small-claims actions or Excluded Claims.

12Arbitration of Website Disputes

(a) Covered claims. A Website Dispute is a claim relating only to your access to or use of the site or these Terms. Except as stated below, these are resolved through binding individual arbitration under the Federal Arbitration Act.

(b) Excluded claims. Arbitration does not cover (i) loan-related claims, including inquiries, applications, and dwelling-secured credit, and related federal claims (15 U.S.C. § 1639c(e)); (ii) claims about our texts or calls; (iii) individual small claims; (iv) public injunctive relief; and (v) claims to protect intellectual property.

(c) Process. The American Arbitration Association administers the case under its Consumer Rules before one arbitrator. You may choose telephone, video, written, or in-person hearings (in Orange County or your county). Your share of fees will not exceed the filing fee for a civil action in Orange County Superior Court, and we pay the rest.

(d) Individual claims only. Class, collective, and representative claims are not permitted, and claims cannot be consolidated.

(e) Jury rights. Nothing waives your right to a jury trial for claims proceeding in court.

(f) Opt-out. You may opt out within 30 days of first using the site after November 3, 2026, by emailing legal.dept@lexingtonhl.net with the subject “Arbitration Opt-Out,” stating your name and intent.

13Governing Law and Courts

These Terms are governed by U.S. federal law and California law, without regard to conflict-of-law rules. Website Disputes not sent to arbitration, and Excluded Claims relating to these Terms, go to state or federal courts in Orange County, California, or small-claims court. Loan-related claims are governed by the loan documents and applicable law. To the extent permitted by law, Website Disputes must be filed within one year after they arise.

14Changes to These Terms

We may update these Terms by posting a revised version with a new effective date. Updates apply to use after that date. If you disagree, stop using the site. Changes are not retroactive.

15General

These Terms, the Privacy Policy, and the Text Messaging Terms form the entire agreement regarding the site and replace any prior site terms. If a provision is unenforceable, it is enforced to the maximum extent allowed, and the rest remains in effect. You may not assign these Terms; we may assign them to an affiliate or successor.
