This Privacy Policy describes how Lexington Mortgage Corporation, dba Lexington Home Loans (NMLS #347811), collects, uses, discloses, and protects personal information.
This policy describes how we may collect, use, disclose, and protect personal information through our website, online forms and applications, text message program, and calls and emails. Other Lexington websites and portals may have their own notices.
If you apply for or obtain a loan, you are also covered by the federal Gramm-Leach-Bliley Act privacy notice, which controls for nonpublic personal information about a loan where the two differ. For California residents: we do not share nonpublic personal information with outside companies for their own marketing without your prior consent.
Information may come from you, our staff, and — with your authorization — credit bureaus, employers, financial institutions, appraisers, title and escrow companies, and public records. Some is collected automatically when you use the site.
We may use information to respond to inquiries and provide quotes and services; process, underwrite, close, and service loans; send the updates and reminders you request; verify identity and prevent fraud; operate and improve the site; offer other loan options where permitted; keep consent and opt-out records; meet legal, licensing, regulatory, and audit obligations; and for any other purpose disclosed at collection or with your consent.
We use your mobile number to send the loan updates and reminders you opted into, under our Text Messaging Terms. Message frequency varies and message and data rates may apply. Reply STOP to opt out or HELP for help.
Mobile information is never shared with third parties or affiliates for marketing or promotional purposes. Mobile information, text opt-in data, and consent are not sold or rented to any party or lead generator. The only parties that handle mobile numbers are the message-delivery service providers, which may use them solely to deliver messages.
Subject to Section 4, information may be disclosed to:
As of the effective date, we do not sell personal information or share it for cross-context behavioral advertising under the CCPA, and have not done so in the past 12 months. We do not knowingly sell or share the data of consumers under 16. Any change will be posted with required notices and choices before it takes effect.
The site and our service providers may use cookies, web beacons, scripts, and similar tools to operate and secure the site, remember preferences, and analyze usage. You may block or delete cookies, though parts of the site may then malfunction.
Do Not Track and Global Privacy Control: the site does not currently respond to Do Not Track signals. Where required by law, a Global Privacy Control signal from a browser is treated as a valid request to opt out of sale or sharing for that browser.
Calls may be recorded and monitored for quality, training, compliance, and recordkeeping, with advance notice where required. Automated tools may help our staff organize information and prepare communications. Loan decisions are made by staff and lending partners under applicable guidelines and law. Where law regulates significant automated decisions, required notices and choices will be provided.
If you agree, we may call you using automated technology or an artificial or AI-generated voice. Those calls say at the start that they are automated, and you may ask for a person or tell us to stop at any time. We keep a record of each consent: the words you agreed to, when, and where.
This section applies to California residents under the CCPA, as amended by the CPRA. Subject to legal exceptions, your rights include:
Making a request: call (855) 585-8800 or email legal.dept@lexingtonhl.net with the subject “California Privacy Request,” or use our online inquiry form and choose “Privacy request (California).” We confirm receipt within 10 business days and respond within 45 calendar days, extendable by up to 45 more. We verify identity by matching provided information against our records. Authorized agents may be used with signed permission.
Exceptions: information governed by the GLBA, the California Financial Information Privacy Act, or the Fair Credit Reporting Act falls under those laws instead. We may retain information where law requires or permits. We will explain any request we cannot fully honor.
Shine the Light: under Civil Code section 1798.83, California residents may ask about disclosures to third parties for their direct marketing. We do not make such disclosures without consent. Requests go to legal.dept@lexingtonhl.net with the subject “Shine the Light,” or through our online inquiry form. We respond within 30 days.
Residents of other states may have privacy rights under their state laws. You can contact us using Section 15, and we will handle requests as your state law requires.
We keep information as long as reasonably necessary. Loan files are kept for periods required by mortgage laws, investor rules, licensing, or legal matters. Consent and opt-out records are kept long enough to honor and document choices. Site technical data is generally kept only as long as needed for security and operations.
We use administrative, technical, and physical safeguards, as federal law requires of mortgage companies, including access controls, encryption where appropriate, and service-provider oversight. No system is completely secure, and absolute security cannot be guaranteed. We will give notice of security incidents as law requires.
The site and services are for adults. We do not knowingly collect information from anyone under 16 and will delete any such information we discover.
We may update this policy to reflect changes in practice or law. Updates will be posted with a new “Last updated” date and additional notice where required. Continued use of the site after an update takes effect means the updated policy applies.
