Text Messaging Terms

Effective November 3, 2026

These terms govern Lexington’s informational text message program for your loan. Message and data rates may apply. Reply STOP to opt out, HELP for help.

1The Program

Lexington Mortgage Corporation, dba Lexington Home Loans, sends informational texts about your own loan inquiry, application, and loan — such as status updates, document requests and receipts, appointment reminders, notices that documents are ready in the secure portal, and replies to messages you send. No marketing or promotional offers are sent. Texts are courtesy notices and do not replace loan documents or legally required disclosures, which are provided in writing or through the portal.

2Consent

You may opt in in one of three ways: by checking an unchecked-by-default box on the sign-up page or loan application, by verbally agreeing on a call with your loan officer after being read the program details, or by texting START to the number. Consent is never required to get a loan. You must be 18 or older and the account holder or an authorized user of the number. Your first message confirms sign-up.

3Message Frequency and Timing

Frequency varies, typically a few messages per week while a loan is in process. Automated messages are sent only between 9 a.m. and 8 p.m. local time, with no more than three per day on the same subject. A member of your loan team may reply to messages you send at any time.

4Message and Data Rates

Lexington does not charge for texts. Your wireless carrier may apply message and data rates.

5How to Opt Out (STOP)

You can reply with STOP (or STOPALL and other listed keywords), use the Stop texts form on the sign-up page, or call (855) 585-8800. Opt-outs are honored promptly and within legal time limits. One confirmation text is sent, and no further texts follow unless you sign up again.

6How to Get Help (HELP) and Restart

Reply HELP or INFO for contact details. Reply START or UNSTOP to re-subscribe the number; this is confirmed by text.

7If Your Number Changes

Please notify us promptly when you change or give up a number. We check numbers against the FCC’s reassigned numbers database before texting and stop texting any number reported as wrong.

8Privacy

Your mobile number is used only for these messages. Mobile information, opt-in data, and consent are not shared, sold, or rented to third parties, affiliates, or lead generators for marketing or promotional purposes. We keep records of consent and opt-outs.

9Carriers

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on the carrier, device, and coverage. Major U.S. wireless carriers are supported.

10Our Responsibility

Texts may be delayed or undelivered for reasons beyond our control, so please do not rely on texts for deadlines — your loan documents and your loan officer are the official sources. We disclaim carrier-related liability to the extent the law permits, and preserve liability that cannot be limited under California Civil Code section 1668 or other applicable law.

11Disputes

These terms do not require arbitration and do not limit your right to sue in court, individually or as a class, under federal or California law. Suits may be filed in a California state or federal court with jurisdiction, or in small-claims court. You are invited, but not required, to contact us before filing a claim. If these terms conflict with loan documents, the loan documents control.

12Changes

We may update these terms. Material changes are announced by text or email at least 30 days in advance and apply only going forward. If you disagree, reply STOP. Each version is kept and available on request.
